DOH Reverts Back to January 1, 2019 Rates

Following up on NYSHFA’s meeting with the Court yesterday, the Court’s Order expressly enjoined the DOH from implementing its new case mix methodology and directed the Department to continue to reimburse providers pursuant to the prior methodology pending the resolution of our litigation. The Court made it clear to DOH that it is violating its Order and demanded an update by COB December 2nd as to how the State is going to move forward to implement the prior January rate and comply with the Court’s Order. In response, DOH has just issued a bulletin below reversing the July 2019 rates, and reverting back to the January 2019 rates.

Dear Provider: 

This note is to inform you that the July 2019 Nursing Home rates that were announced in the October 9, 2019 letter will be reversed and the rates will revert back to the January 2019 rates. Refer to the November 21, 2019 letter regarding the timeline/process regarding updates to the July 2019 rates.
